Terms of Service
Please read these terms carefully before using the Tributum platform.
Effective Date: March 1, 2026 | Governing Law: State of DelawareImportant: Not Financial Advice
Tributum provides financial data visualization, bookkeeping tools, and AI-assisted analysis. We are not a licensed financial advisor, registered investment advisor (RIA), certified public accountant (CPA), or licensed tax professional.
Nothing on this platform — including dashboards, AI-generated insights, recommendations, forecasts, or any other output — constitutes financial, investment, tax, accounting, or legal advice. All information is provided for informational and organizational purposes only.
Always consult a qualified and licensed professional before making any financial, investment, tax, or business decisions. Tributum expressly disclaims any liability for decisions made based on information provided through the platform.
1. Acceptance of Terms
By accessing or using any part of the Tributum platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service.
These Terms apply to all users, including clients, visitors, and anyone who accesses the Service. The Tributum Group ("Tributum," "we," "us," or "our") reserves the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify registered users of material changes by email.
2. Description of Service
Tributum is a financial management platform for small businesses that provides:
- Financial dashboard and reporting tools
- Bookkeeping and income statement tracking
- Integration with third-party financial systems (QuickBooks, Plaid, POS platforms)
- Cash flow and financial forecasting tools
- AI-assisted financial analysis and recommendations (Tier 3)
The Service is offered on a subscription basis with tiered access levels. Features available to you depend on your current subscription tier.
Geographic Scope
Tributum primarily serves clients in the United States, with a focus on Kentucky, Indiana, Ohio, and Tennessee. We welcome clients from all U.S. states.
3. User Accounts
Account Creation
You must submit an application and receive approval from Tributum to access the platform. You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at support@thetributumgroup.com of any unauthorized use of your account.
Account Accuracy
You agree to provide accurate, current, and complete information during the application process and to update such information as necessary. Accounts found to contain false information may be suspended or terminated.
One Account Per Business
Each subscription is for a single business entity. You may not share access credentials with individuals outside your organization or use a single subscription for multiple unrelated businesses.
4. Payment and Subscriptions
Billing
Paid subscriptions are billed on a quarterly (every 3 months) or annual basis via Stripe. By subscribing, you authorize Tributum to automatically charge your saved payment method for each renewal period. To ensure uninterrupted access, renewal charges are processed approximately 30 days before your current period ends. You will receive an advance notice email before each automatic renewal.
Pricing
| Tier | Monthly Rate | Billed Quarterly | Billed Annually | Key Features |
|---|---|---|---|---|
| Free | $0 | $0 | $0 | Income statement tracking, basic dashboard |
| Tier 1 | $89/month | $267 / quarter | $899 / year | Full dashboard, financial statements, system integrations |
| Tier 2 | $299/month | $897 / quarter | $3,000 / year | Tier 1 + advanced recommendations, performance analytics |
| Tier 3 | $699/month | $2,097 / quarter | $7,500 / year | Tier 2 + AI-powered strategic insights and chat |
All prices in USD. A 3% card processing surcharge applies. Applicable state and local SaaS taxes are added at checkout based on your registered business address.
Auto-Renewal
Subscriptions renew automatically on a quarterly basis unless you cancel before the end of the current billing period. If you have selected annual billing, your subscription renews annually instead. Approximately 30 days before your renewal date, Tributum will charge the payment method on file for your next period, and will send a written renewal notice to your registered email address. Your access to the Service continues through the end of the current paid billing period regardless of when you cancel. To prevent the next renewal charge, you must cancel before the auto-renewal charge date by contacting support or managing your subscription in your account settings.
Failed Payments
If an automatic renewal payment fails, we will retry up to three times over seven days. If payment is not collected, your account will be downgraded to the free tier at the end of your current paid period. Access is restored immediately upon successful payment.
Cancellation
You may cancel your subscription at any time. Cancellation prevents the next auto-renewal charge. Your paid access continues until the end of your current billing period, after which your account is suspended. Your account and associated data remain available in a read-only state for 60 days following cancellation, during which you may reactivate by resuming a paid subscription. If no reactivation occurs within 60 days of cancellation, your account and all associated data are permanently deleted from our systems. No prorated refunds are issued for unused portions of a billing period.
Refund Policy
All subscription fees are non-refundable unless Tributum has materially failed to provide the Service as described and has been given reasonable opportunity to cure the failure. Refund requests must be submitted to support@thetributumgroup.com within 30 days of the charge.
5. Service Level Agreement (SLA)
Uptime Commitment
Tributum targets 99% monthly uptime for the core platform (dashboard access, data retrieval, and account management). "Uptime" is measured as the percentage of minutes in a calendar month during which the Service is accessible and operational, excluding scheduled maintenance windows and excluded events defined below.
Service Credits
If monthly uptime falls below 99%, you may request a service credit equal to a prorated day of your monthly subscription fee for each hour of downtime beyond the SLA threshold, up to a maximum of one month's subscription fee. Service credits are applied to future invoices and are the sole remedy for SLA failures.
| Monthly Uptime | Credit |
|---|---|
| 99.0% or above | No credit |
| 95.0% – 98.9% | 10% of monthly fee |
| 90.0% – 94.9% | 25% of monthly fee |
| Below 90% | 50% of monthly fee |
Exclusions
The SLA does not apply to downtime caused by:
- Scheduled maintenance (communicated at least 24 hours in advance)
- Third-party service outages (Supabase, Plaid, QuickBooks, Stripe, or any connected POS system)
- Force majeure events (natural disasters, internet infrastructure failures, government actions)
- Your actions or inactions, including misconfigured integrations or unauthorized access attempts
- Free tier accounts (SLA applies to paid tiers only)
Claiming Credits
To claim a service credit, email support@thetributumgroup.com within 30 days of the incident with the subject line "SLA Credit Request." Include the dates and times of downtime experienced. Credits are issued at our discretion after verification.
6. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.
Your Data
You retain ownership of all financial data, business information, and documents you provide to the Service. You grant Tributum a limited license to process and store this data solely to provide the Service to you. We do not sell your data to third parties.
Data Accuracy
Tributum does not guarantee the accuracy of data imported from third-party systems (QuickBooks, Plaid, POS platforms, or other integrations). Dashboard figures, forecasts, and reports are only as accurate as the underlying source data. You are responsible for verifying the accuracy of connected data sources.
Financial Export Reports
Tributum provides financial export reports formatted for use with lenders, banks, and accounting professionals. These reports are generated from data you have provided or connected through third-party integrations. They are not audited, certified, or prepared by a licensed CPA or financial professional. These reports have not been prepared, reviewed, or certified by a licensed accountant, auditor, or financial professional. They should not be relied upon as independently certified financial statements. Tributum expressly disclaims any responsibility for decisions made by third parties based on these reports.
Data Retention on Cancellation
Upon cancellation of your subscription, your financial data (including transaction records, financial statements, and connected account data) will be retained for 60 days and then permanently deleted, except for a 7-year audit archive of records required for legal or tax compliance. During this 60-day window your account is suspended (not deleted), giving you time to export data or reactivate your subscription. You are responsible for exporting any data you wish to keep before the 60-day window closes.
Non-financial account information (including your name, email address, company name, and contact information) may be retained for up to 7 years for business records purposes.
7. Third-Party Integrations
The Service connects to third-party platforms including QuickBooks, Plaid, Square, Shopify, Clover, Toast, and Stripe. These connections are governed by the respective third parties' terms of service and privacy policies. Tributum is not responsible for the availability, accuracy, or behavior of third-party services.
When you connect a third-party account, you authorize Tributum to access that account on your behalf within the permissions you grant. You may disconnect any integration at any time from within your dashboard.
8. AI-Generated Content (Tier 3)
Tier 3 subscribers receive access to AI-powered insights, recommendations, and a conversational interface powered by large language model technology. You acknowledge and agree that:
- AI-generated content is for informational purposes only and does not constitute professional financial, tax, legal, or investment advice
- AI outputs may contain errors, omissions, or inaccuracies and should not be relied upon as the sole basis for any business decision
- Your financial data is processed by the AI model to generate personalized insights; see the Privacy Policy for details
- Tributum is not liable for any decisions made based on AI-generated content
9. Professional and Regulated Industry Clients
Law Firms and Legal Practices
Tributum serves law firms and solo legal practitioners as a financial management tool for their own business operations — tracking revenue, expenses, payroll, and cash flow. Using the Tributum platform does not create an attorney-client relationship between you and Tributum, nor does it affect any attorney-client relationship between your firm and its clients. Tributum does not have access to, and you agree not to input, any client matter data, case files, privileged communications, or information protected by attorney-client privilege. The platform is strictly for the financial management of your practice.
Healthcare, Dental, and Veterinary Practices
Tributum serves medical practices, dental offices, and veterinary clinics as a financial management tool. Tributum is not a HIPAA covered entity or business associate. The platform is designed to manage your practice's business financials — revenue, expenses, insurance reimbursements (as revenue line items), payroll, and overhead — and is not designed to store, process, or transmit protected health information (PHI) as defined under HIPAA. You agree not to input any patient names, medical record numbers, diagnoses, treatment information, or other PHI into the Tributum platform. If you believe PHI has been entered accidentally, please contact us immediately at support@thetributumgroup.com to request deletion. Tributum expressly disclaims any obligations as a HIPAA business associate unless a separate, written Business Associate Agreement has been executed.
10. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
- Attempt to reverse engineer, decompile, or extract source code from the platform
- Use automated bots or scrapers to access the Service
- Attempt to gain unauthorized access to other users' accounts or Tributum's systems
- Use the Service to process or store data that violates a third party's intellectual property or privacy rights
- Resell or sublicense access to the Service without our written consent
11. Intellectual Property
The Service, including all software, design, content, trademarks, and technology, is and remains the exclusive property of The Tributum Group. Nothing in these Terms grants you any right to use Tributum's name, logos, or trademarks without our prior written consent.
You retain all ownership rights to your data. You grant Tributum a non-exclusive, royalty-free license to use aggregated, anonymized data derived from your use of the Service to improve the platform, subject to our Privacy Policy.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Tributum's total liability to you for any claim arising from or related to the Service shall not exceed the total fees paid by you in the twelve (12) months preceding the claim.
In no event shall Tributum be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, loss of business opportunity, or loss of data, even if Tributum has been advised of the possibility of such damages.
This limitation applies regardless of the legal theory under which the claim is brought, including contract, tort, negligence, strict liability, or otherwise.
13. Indemnification
You agree to indemnify, defend, and hold harmless Tributum and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in connection with:
- Your use of the Service in violation of these Terms
- Your violation of any applicable law or regulation
- Inaccurate data you provide to the Service that results in incorrect outputs
- Any claim by a third party arising from your use of the Service
14. Termination
Tributum reserves the right to suspend or terminate your account, with or without notice, for:
- Non-payment of subscription fees
- Violation of these Terms
- Fraudulent, abusive, or illegal activity
- Extended account inactivity (12+ months on a paid tier)
Upon termination by Tributum, your right to access the Service ceases immediately. Your data will be retained for 60 days per the data retention policy above, after which it is permanently deleted.
15. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TRIBUTUM DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. TRIBUTUM DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT, DATA, OR INFORMATION AVAILABLE THROUGH THE SERVICE.
16. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or the Service shall first be submitted to good-faith negotiation. If negotiation fails within 30 days, disputes shall be resolved by binding arbitration in the State of Delaware under the rules of the American Arbitration Association. Class action lawsuits and class-wide arbitration are waived to the extent permitted by law.
Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.
17. Changes to These Terms
We may update these Terms from time to time. We will notify registered users of material changes via email at least 14 days before the changes take effect. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.
The most current version of these Terms is always available at thetributumgroup.com/terms.
